1 PM EST IS THE DAILY CUT-OFF FOR THAT BUSINESS DAY TO COUNT IN PRODUCTION. 10 AM EST FOR SAME DAY BANNER ORDERS. FILES MUST BE PRINT READY.
IF THE ARTWORK YOUR SUPPLY IS NOT THE PROPER RESOLUTION OR DOES NOT FIT THE DIMENSIONS OF YOUR BANNER WE WILL ATTEMPT TO CORRECT IT FOR YOU, OR PRINT AS IS AT OUR DISCRETION. IN AN EFFORT TO KEEP YOUR ORDER ON TIME, WE MAY PROOF YOU AND IF WE DON'T HEAR BACK FROM YOU IN 24 HOURS WE WILL PROCEED WITH THE NEW ARTWORK. WE ARE NOT RESPONSIBLE FOR THE POOR QUALITY OF ARTWORK SUBMITTED THAT DOES NOT FOLLOW OUR DESIGN GUIDELINES.
WE ARE NOT RESPONSIBLE FOR PACKAGES LEFT AT YOUR DELIVERY ADDRESS BY THE CARRIER. WE RESERVE THE RIGHT TO USE A PRODUCTION/SHIPPING METHOD THAT MAY DIFFER FROM YOUR ORDER THAT WILL RESULT IN YOU RECEIVING YOUR ORDER FASTER OR ON THE SAME DUE DATE. The Title for finished work shall pass to the customer upon shipment of finished work. We reserve the right to alter shipping methods/carriers to meet better your original order delivery date (Original order printing time plus original transit time equals the due date). Please note that the revised shipping total or method may not be adjusted on your invoice. Shipping prices listed are for the continental United States only. The customer is solely responsible for providing a valid USPS / UPS / FEDEX delivery address and for accepting delivery. Any fees from shipping companies due to incorrect information being provided by the customer will be passed on to the customer. When flat rate shipping is offered, it is valid only in the continental US. Freight estimates are subject to change due to actual freight cost at time of shipping. Dutys and fees where applicable are your responsibility.
All contracts are made contingent upon wars, strikes, fires, floods, accidents, or other emergencies beyond the control of 2DayBanners.com. Every effort will be made to effect delivery at the desired time. Under the current state of overwhelmed infustructures because of COVID, delivery dates are not guaranteed. Refunds due to shipping delays on the carriers' end due to weather, acts of God, or events out of our control are limited to a refund or adjustment of the shipping fee only if the order is 48hrs late or more.
Once an Order has been moved into "IN PRINT PRODUCTION" it CANNOT BE CANCELED. Orders regularly entered, verbal or written cannot be canceled except upon terms that will compensate 2DayBanners.com for time spent processing an order, labor and materials through the date of cancellation. The minimum cancellation fee is $20
3. COLOR MATCHING
AS A GENERAL RULE, WE DO NOT COLOR MATCH. Colors will most likely shift if you provide Pantone or RGB files. If you need exact color matching, please request a quote here. Most of our clients choose the convenience of lower prices over the accuracy of PMS or custom run printing. We will print all orders as gang-run CMYK unless specifically ordered otherwise. PMS inks and select stocks will be used upon custom quote request and charged at current rates. For a better understanding of how to provide us files, please fully read our Design Guide found here.
4. COLOR PROOFING & PROOFS
Desktop monitors and mobile devices do not reflect proper color for proofing purposes. The difference in equipment, photography, separations, computer technology, computer printing, computer color proofs, paper, other substrates, inks and other conditions affect the printing process in various ways. Therefore, small differences between the color you see on your screen and a completed job shall constitute acceptable delivery.
It is the responsibility of the customer to proofread their artwork and designs for errors. 2DayBanners.com is not responsible for errors missed by the customer. Proofs shall be submitted for customer approval only when requested at the time an order is placed. Corrections are to be made and signed by the customer. If revised proofs are desired, the request must be made when proofs are returned to 2DayBanners.com. We cannot be held responsible for errors if the work is printed or otherwise produced according to customer's approval. Any changes, corrections or lost press or production time due to customer's non-availability, change of mind, indecision or delay will be charged at current rates. Any job requiring re-proofing will be subject to a re-proof fee of $10 per file or more. Your production time schedule begins at the time of proof approval following our 1PM cutoff.
5. PRODUCTION SCHEDULES
PRINTING TIME IS THE TIME IT TAKES TO PRINT A JOB. SHIPPING TIME IS ADDITIONAL. 5PM EST is our cut-off for standard production. 1PM EST is the cutt-off for Same Day. To meet this cut-off files must be print-ready. Submitting files that are not print ready may delay your production schedule. Production schedules will be established and adhered to by the customer and 2DayBanners.com provided that neither shall incur any liability or penalty for delays including delays due to weather, state of war, riot, civil disorder, fire, strikes, accidents, acts of government or civil authority, acts of God, or other causes beyond the control of customer or 2DayBanners.com.
6. QUOTATIONS, ESTIMATES, AND TAXES
We honor all written quotes for 30 days. Verbal quotes are not accepted. All quotes are subject to review by management before work begins. Quotations are also subject to review if they are not accepted within seven days, returned without a deposit, work does not commence within 30 days after acceptance, or work does not proceed with continuous production. 2DayBanners.com and its parent company, An ICON Company, LLC, has the right to invoice for the work process if a customer interrupts production for more than seven working days. The prices quoted are based on current production and badge costs. Price adjustments may be made at the time an order is placed if materials or labor costs have increased, or if preferential scheduling is required by the client to meet customer-desired delivery dates. All estimates based on visuals, rough dummies, sketches, copies, etc., whether accompanied by verbal or written specification, shall be considered only tentative. Estimates are subject to revision upon inspection of the finished artwork or manuscript. Customer will be notified of price changes if any before a job moves into final production. Local, state, and federal taxes and duties are not included in any quote and may be added to all applicable invoices.
7. CREDIT AND TERMS
All estimates and quotations are contingent upon credit approval by 2DayBanners.com. Payment is due in advance for all credit card orders and orders under $1000. For all other orders, customers must deposit 50% at the time an order is placed with the rest of the balance being due the day the proof is approved. All work approved for "term" invoicing by 2DayBanners.com shall require a 50% deposit and the rest of the balance shall be due when the job is picked up or delivered (unless otherwise provided in writing). No creative writing designs or other artwork of any kind shall be released for printing elsewhere until full payment has been submitted to 2DayBanners.com. Additionally, 50% of estimated printing costs will be required before acting as a printing agent for a customer. All previous orders from any customer or their agent must be paid in full before any new order can be shipped or picked up. Credit card charges will appear on your bill from PrintDirtCheap or an ICON Company, llc. All unpaid balances are subject to 3% interest compounded monthly.
8. EXPERIMENTAL WORK
Experimental work (also called sample or test jobs) performed at customer's request, including but not limited to creative writing, sketches, drawings, composition, plated, press-work, photography, mock-up, and press proofs, or completed jobs will be charged for at current rates and may not be used commercially or with reference to 2DayBanners.com without the consent of 2DayBanners.com. Experimental work is done “as is” with no warranty.
9. PREPARATORY & MATERIAL
Creative writing, sketches, copy, dummies and all preparatory work shall remain the exclusive intellectual property of 2DayBanners.com. It is prohibited to use the exclusive intellectual property of 2DayBanners.com without appropriate compensation.
Title to design, type, artwork, film, computer design, computer diskettes, plates, dies, tools, mock-ups, creative writing and other property created or furnished by 2DayBanners.com with respect to the production of goods shall remain property of 2DayBanners.com until the customer has remitted total balance due for such specific work to 2DayBanners.com.
Alterations represent work performed in addition to the original specification. Such additional work shall be charged at current rates and be supported with documentation upon request.
12. SPECIFICATION DEFICIENCIES
Additional costs due to specification deficiencies by a customer shall be charged to the customer at current rates.
13. CUSTOMER RESPONSIBILITY
It is the responsibility of the customer to proofread their proofs. It is the responsibility of the customer to request a PMS quote when PMS printing is desired. When proofreading, layout, design, composition, paper stock, the color of inks, the color of foils, etc. are not specified by the customer and are left to the discretion of 2DayBanners.com, no further responsibility on the part of 2DayBanners.com will be incurred except the use of reasonable care and good judgment. Any customer alterations from the above will be charged for at current rates. It is the customers responsibility to check these terms for changes during the checkout process whenever placing an order.
14. PRINTING OVERRUNS / UNDERRUNS
We will produce no over or under-runs
15. OVERTIME WORK
Overtime work caused by a customer's failure to meet deadlines, delay in returning approved copy, or other materials necessary to complete the work within the time specified shall be charged at current overtime rates, over and above the price quoted herein. When an agreed deadline is missed due to a customer, no new delivery date is to be assumed without specific rescheduling with 2DayBanners.com.
16. CUSTOMER-FURNISHED MATERIALS
Creative writing, camera copy, film, diskettes, prints, display items, products color separations, paper stock, illustrations, composition, mock-ups, and other customer-furnished materials shall be handled with frugality to prevent damage or undue spoilage. Materials delivered from the customer or his suppliers are verified with a delivery ticket. The accuracy of quantities indicated on such tickets cannot be verified, and 2DayBanners.com cannot accept responsibility for shortage based on supplier's tickets. All shortages and material defects will be reported immediately to the customer for his disposition with the supplier or freight handler. Whenever possible, 2DayBanners.com will assist customers regarding shortages, damages, and materials defects; however, the customer must bear full responsibility when dealing with his supplier. 2DayBanners.com accepts no responsibility for the accuracy, suitability or usability of customer-furnished materials.
While we provide temporary storage service free of charge for creative writing, layouts, film and other materials necessary to complete a job for the customer, as long as space permits, we accept no liability for the safekeeping of the materials nor the liability for replacing any materials lost or damaged while in storage. Unless specifically provided for in writing, the prices in this proposal do not include a charge for storage of finished, sample, or exhibit goods, nor for the storage of paper or other materials, the customer may furnish. Charges at current rates will be made for all such property stored at the customer's request. 2DayBanners.com shall not be liable for any loss or damage occasioned by any cause including but not limited to fire, water, leakage, theft, negligence, insects, rodents, or breakage.
All claims of any kind must be made in writing within 5 days of receipt of goods, and in cases of shortages or errors in shipment, must be accompanied by a receiving report showing the number of pieces received and the weight and contents of each piece. Failure to make such claim immediately shall constitute irrevocable acceptance and admission that they fully comply with the terms, conditions and specifications. Any claim resulting from a quality control issue will be resolved once the product has been returned for inspection. If the product is not returned within 7 days of reciept of goods, the claim will be considered closed. Due to the non-reusable nature of custom banners we do not offer refunds.
Subcontractors may be subcontracted for any or all of its obligations but shall remain liable to the customer.
20. REPRINTS AND SAMPLES
2DayBanners.com has the privilege of displaying samples of the work for advertising purposes and the right to imprint their name on the sample copies unless expressly prohibited by customers.
21. LIMITATIONS ON LIABILITY
Liability shall be limited to the stated selling price of any goods and in no event shall include special or consequential damages, including profits (or profits loss) or claims of any third party on the work.
Government regulations may require wind vents in banners in some areas*. This may be the case if banners are over a certain size. The slits can be 6 to 8 inch V shaped slits or "smiley face" half circles. 2DayBanners.com and an ICON company, LLC shall not be held liable for improper use and installation of the banners and you agree that all liability shall remain with you the buyer and or installer of banners purchased from us.
(*We also offer mesh banner material which may be needed for certain regulations. Mesh banners may have a different cost than our other banners.)
22. RIGHT OF REFUSAL
The customer agrees that 2DayBanners.com may refuse to reproduce any copy, photographs, or illustrations of any kind that in our sole judgment is believed to be an invasion of privacy, is degrading, libelous, unlawful, profane, obscene, pornographic, tends to ridicule or embarrass, depicts bodily harm or self harm or is in bad taste.
The customer shall indemnify and hold harmless any and all subcontractors from any and all loss, cost, expense and damages on account of any and all manner of claims, demands, actions and proceedings that may be instituted against the customer on grounds alleging that the said work violates any copyright or propriety right of any person or that it contains any matter that is libelous, scandalous or invades any person's right to privacy or other personal rights except to the extent that shall give to the customer such reasonable time as the exigencies of the situation may permit in which to undertake and continue the defense thereof.
2DayBanners.com may alter these terms at any time and will notify our customers via email, however It is the customers responsibility to check these terms for changes during the checkout process whenever placing an order.
